1. Service scope
DigitalFieldGuide.app provides a managed software-as-a-service platform for businesses, institutions, and other organisations that need to distribute operational content such as SOPs, field guides, handbooks, and training references. The service is intended for organisational deployment and controlled internal distribution. It is not offered as a public publishing platform or a general consumer content service.
2. Business customers only
The service is made available to businesses, institutions, non-profits, and similar organisations. By subscribing or using the service on behalf of a customer organisation, you represent that you are authorised to bind that organisation to these terms.
3. Customer content and submission rights
Customers may submit content in PDF format and other agreed formats for inclusion in a digital guide. You warrant that your organisation owns or has sufficient rights, permissions, and authority to submit, process, distribute, and use that content through the service. You remain responsible for the accuracy, legality, completeness, and appropriateness of all submitted materials.
4. Managed preparation of content
DigitalFieldGuide.app may process, format, organise, reject, delay, or request clarification regarding submitted content as part of preparing materials for platform use. This managed setup does not transfer responsibility for the underlying content from the customer to DigitalFieldGuide.app.
5. AI-assisted processing
DigitalFieldGuide.app may use artificial intelligence and related automation tools to assist with document extraction, structuring, formatting, and preparation for platform use. Any such use is intended to support the onboarding and integration process and does not shift responsibility for the underlying content away from the customer. Customers will have a reasonable opportunity to review prepared content and request corrections before final deployment or wider organisational release.
6. Reasonable Use
The subscription includes onboarding and integration of submitted content within reasonable operational limits. The Licensee may submit content such as SOPs and field guides for inclusion in the Software as part of normal use of the service. Where content submissions are unusually large in volume, complex in structure, or require substantial processing or configuration, the Licensor reserves the right to scope such work separately and agree on additional fees where applicable.
7. Permitted use and platform limits
The platform is intended as an informational and operational reference tool for organisational users. It is not intended for open public submissions, public-facing community publishing, or unmanaged user-generated content. The platform should not be relied upon as the sole source for emergency decisions, safety-critical activity, or other high-risk operational situations without appropriate organisational judgment, oversight, and controls.
8. Fees and payment
Unless otherwise agreed in writing, the standard subscription fee is €250 per month. Fees are billed in advance on a recurring basis and are payable through the selected billing provider. Failure to pay may result in suspension or restriction of service access until outstanding amounts are resolved.
9. Availability, maintenance, and updates
DigitalFieldGuide.app will use reasonable efforts to provide ongoing service availability, but uninterrupted or error-free operation is not guaranteed. Maintenance, updates, fixes, and operational changes may occur from time to time and may affect access or functionality on a temporary basis.
10. Suspension and termination
Access may be suspended or terminated if fees remain unpaid, if customer use materially breaches these terms, or if submitted content appears unlawful, infringing, harmful, or inconsistent with the intended organisational use of the platform. Customers may cancel to stop future renewals, subject to the refund policy and any billing terms then in effect.
11. Disclaimer
Except to the extent required by law, the service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DigitalFieldGuide.app does not warrant that the service will meet every customer requirement or that content submitted by customers will be complete, accurate, or suitable for every use case.
12. Limitation of liability
To the maximum extent permitted by applicable law, DigitalFieldGuide.app and its operators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, business interruption, or data arising from or related to the service. The total aggregate liability of DigitalFieldGuide.app for claims arising out of or relating to the service will not exceed the amount paid by the customer for the service during the three months preceding the event giving rise to the claim.
13. Governing law
These terms are governed by the laws of the State of Wyoming, without regard to conflict of laws rules. Courts located in Wyoming will have jurisdiction over disputes arising from or relating to these terms, subject to applicable law.
